Business Immigration Support

Immigration law is complex and subject to frequent changes.  The business immigration support team at Dallas McMillan provide practical, cost efficient and an innovative service.

Our team provides a suite of legal services and compliance management solutions enabling our commercial clients to implement the Points Based System legislation and facilitate their business operations. We are here to ensure the whole process runs smoothly for you. We will advise you at all stages, collate your materials, prepare and lodge the application and follow up with the authorities to ensure that your application is processed as quickly as possible.

PBS Applications

Certificates of Sponsorship

The PBS legislation introduced Certificates of Sponsorship (CoS), replacing the Work Permit scheme. CoS are assigned using the UK Border Agency's (UKBA) online Sponsorship Management System.

The CoS system is a self-certifying system, meaning checks which were previously made by the UKBA must now be completed by your company. If you fail to comply with the legislation in full or fail to retain the prescribed documentary evidence demonstrating 100% compliance, your company will be fined and your licence maybe suspended or revoked.

We can assist your organisation in drafting and assigning Certificates of Sponsorship and train your staff to use the UKBA’s Sponsorship Management System, or manage the whole process on your behalf.

PBS Sponsor Licence

Points-Based System Sponsor's Licence

The Points-Based System (PBS) is the most radical reform of the immigration system for 45 years. There are now five tiers in the route to work and study in the UK.

Tier 1 - highly skilled migrants
Tier 2 - skilled workers who are sponsored by an employer
Tier 3 - low skilled temporary workers (category on-hold indefinitely)
Tier 4 - students
Tier 5 - youth mobility and temporary workers

UK Employers who wish to sponsor a migrant to work in the UK must apply for a Tier 2 license from the UK Border Agency.

Sponsor’s Licence

Applying for a Tier 2 Sponsor’s licence involves a detailed online application process. The questions are complex and require rigorous assessment of records and collation of data before proceeding. The application process usually takes eight weeks to be processed by UKBA and prior to approving an application, UKBA may decide to inspect your premises and employee records.  We can assist your company with your PBS licence application and the documentation you will need to submit.

The team has a wealth of experience and legal knowledge of the practices and procedures of the British immigration authorities and consular applications.
