A Brave New World in Conveyancing

The Scottish legal profession is entering a brave new world which will eventually change the way in conveyancing is practised in Scotland beyond virtually all recognition.

Firstly, a whole raft of far reaching and ambitious changes were introduced by the Land Registration etc. (Scotland) Act 2012 , most of which have yet to come into effect.

The changes include:-

  • electronic documents (including electronic conveyancing),and
  • Advance notices to cover the “gap” between delivery and registration of a disposition.

Further, as part of the Scottish Government’s 2013/2014 legislative programme they have announced a new bill to allow execution in counterpart and to formally permit electronic conclusion of contracts.

It will be very interesting to see how these changes will be received by a profession which is renowned for being cautious. At Dallas McMillan we are looking forward to guiding clients through the changes. Should you be interested in finding out how the changes might affect you or the services we provide contact us.
