"I've been in an accident - How do i make a claim?"

After recovering from the shock and upset of being involved in an accident that wasn’t your fault, you may think about pursuing a personal injury claim.  For the vast majority of people this can be the first time they have ever considered making a claim for an injury. 

“Where do I start; how do I make a claim?”  “What does the claim process actually involve?”  At Dallas McMillan, we are here to help.  We will explain the process of making a claim for compensation in simple terms and explain exactly what is involved and what you can expect to happen.

We can be contacted by telephone or arrange a face to face meeting for an initial discussion about your accident and advise you at that time about the prospects of success of your claim and confirm if we can be of assistance to you.

From the information you provide, we will determine who is at fault for your accident and we will write directly to that person/company/insurance company advising them that you have been involved in an accident and that we hold them/their driver/their employee at fault for your accident, explain how you have been injured and that you are seeking compensation.

Representatives for the person/company at fault for your accident will have to investigate your claim.  This does take time but when the investigations are complete the representatives will be in a position to accept or deny liability for your accident.

Good news! 

The party at fault has accepted responsibility for your accident and are agreeing to pay you compensation.

 

An explanation is usually provided detailing why liability has been denied.  We will discuss these reasons with you and determine how best to respond.

The injuries you have suffered and the seriousness of those injuries are how we value your claim.  We will instruct a medical expert, normally a consultant surgeon who has expertise in the area of your injury.

 

We may have to obtain further evidence e.g. witness statements or documents.

You will attend an appointment with the medical expert.  You will be examined and the medical expert will prepare a report.  This report is very important as it details your injuries, and crucially confirms that they were caused by the accident.  You will receive a copy of your medical report.

 

If the party at fault is not persuaded to admit liability after we provide further evidence we will to review all of the evidence in your case and discuss with you whether your case would be successful if we began a court action on your behalf. 

We will include in your claim all other losses you have incurred as a direct result of your accident, e.g loss of earnings or travel costs.

 

The next step is different in each case.  We will discuss you options with you fully and provide you with our advice on how to proceed. 

We will prepare a valuation of your claim based on your medical evidence and include all other associated losses. 

 

 

We will send this to representatives for the party responsible and negotiate settlement.

We will provide you with advice on any settlement offer and if you are happy with the offer, we will accept this on your behalf.

 

 

If the offer is too low we will to review all of the evidence in your case and discuss with you whether your case would be successful if we began a court action on your behalf.

 

 

The next step is different in each case.  We will discuss your options with you fully and provide you with our advice on how to proceed.
